It has been a longstanding MTA policy for the South Australian Government to update the Second-hand Vehicle Dealers Act and as part of this we are pleased that a significant amendment is being considered to increase odometer tampering penalties.
Just recently, the government announced a higher threshold of penalties. Any seller convicted for winding back an odometer will now face imprisonment for up to two years or a fine of up to $30,000.
Whilst promising, these punishments still do not go far enough. We know that Magistrates are not always imposing these orders and are failing to send a strong enough deterrent.
The MTA has accordingly had discussions with the government and they will now be considering increasing the financial penalty to up to $150,000. This increase is strongly supported by the MTA and we are pleased to have been listened to.
Separately, there are also a number of additional amendments the MTA is working through.
Many states in Australia do not have the requirement on dealers and auctioneers to keep and provide previous owner details, even upon request. The current draft legislation imposes such a requirement.
The MTA is concerned that as a result, licensed dealers and auctioneers in South Australia may find themselves non-compliant through no fault of their own when retailing vehicles.
The last thing we want is to burden businesses with even more red tape. The MTA Policy and Advocacy Team will continue its open dialogue with the State Government to ensure the legislative framework meets the requirements of industry.
