All awards include Individual Flexibility Arrangement clauses to enable an employee and employer to make alternative arrangements to suit their needs.
In awards you can use an IFA to vary clauses about:
- arrangements for when work is performed, such as working hours
- overtime rates
- penalty rates
- allowances
- annual leave loading
An IFA can only be made after the employee has started working for the employer. An agreement must be one genuinely made between an employee and employer without duress.
A employer who initiates the making of an agreement must give a proposal in writing and the agreement must be in writing.
